Employment Discrimination

New York Workplace Discrimination Lawyers

Job discrimination takes on a variety of appearances, depending upon which side of the hiring desk you are on. While there are some exceptions, generally employers are prohibited by state and federal laws from discriminating against an employee in hiring, work assignment, promotion or discharge decisions because of:

  • Race and Color
  • Disability
  • Creed or Religion
  • Sexual Orientation
  • Country of Natural Origin
  • Marital or Family Status
  • Sex
  • Military Status
  • Age
  • HIV/AIDS Status

If you are the owner of a small or medium sized business, or if you are an employee involved in a discrimination dispute, the employment law firm of Sapir & Frumkin LLP, in White Plains, New York, has the experience and knowledge to help. For more than a dozen years, Sapir & Frumkin LLP has been recognized as a leading workplace discrimination law firm, advising and representing individuals and businesses on all matters related to workplace discrimination.

Employers are subject to a variety of municipal, state, and federal laws governing discrimination in the workplace such as the Civil Rights Act (title VII), the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and the New York State Human Rights Act. Other city and state laws may provide additional protections for employees. For example, the New York City Human Rights Law prohibits discrimination because of a criminal arrest or conviction, or status as a victim of domestic violence.

Uniformed Services Employment and Reemployment Rights (USERRA)

Every workplace is required to post a sign that informs employees of their rights under the Uniformed Services Employment and Reemployment Rights Act (USERRA). USERRA prohibits employers from discrimination against employees because of their service in the U.S. armed forces. USERRA laws protect employees, but they are not intended to be a burden on employers. Individual conditions and requirements are often points of dispute between employers and workers.

Whether you are an employer or a worker, if you have concerns about a dispute involving USERRA laws, don't try to resolve the issue alone. Contact Donald Sapir, William Frumkin, or another Sapir and Frumkin attorney, for legal advice and guidance you can rely on.
